Terms of Service

1.Rental Agreement

When you rent a portable restroom, luxury bathroom trailer, or related equipment through the Website, you are entering into a rental agreement either directly with Foothill Rentals or with one of our vetted local partner companies. The servicing company is responsible for delivering, servicing, maintaining, and picking up the rental units. They are also responsible for ensuring that all units are clean, in good working condition, and comply with all local health and safety regulations.

2.Payment

All payments for portable restroom rentals must be made in accordance with the payment terms specified at the time of booking. Prices for rentals are estimates and may vary depending on the location, duration, type of unit, service frequency, and additional features requested. All prices are subject to change without notice. Additional charges may apply for damages, excessive cleaning, extended rental periods, or special event requirements.

3.Delivery and Pickup

The servicing company (whether Foothill Rentals or a partner company) is responsible for delivering and picking up the portable restroom units. Delivery and pickup dates and times will be scheduled based on availability and routing efficiency. While we strive to accommodate specific timing requests, we cannot guarantee exact delivery or pickup times. Customer must ensure adequate access and a suitable, level placement location for all units.

4.Service and Maintenance

Regular service and maintenance schedules will be established at the time of rental. Service includes pumping, cleaning, restocking supplies, and sanitizing units. Service frequency may vary based on usage levels and rental agreement terms. Customer must ensure units remain accessible for scheduled service. Additional service calls may incur extra charges.

5.Customer Responsibilities

You are responsible for:

• Ensuring units are used properly and in accordance with their intended purpose
• Preventing vandalism, damage, or theft of rental units
• Notifying us immediately of any damage, malfunction, or service issues
• Ensuring units are not moved from their delivered location without prior approval
• Keeping the area around units clear and accessible
• Complying with all local regulations regarding portable restroom placement and use

6.Prohibited Uses

Rental units may not be used for disposal of hazardous materials, chemicals, flammable substances, or any materials other than human waste and provided toilet paper. Failure to comply may result in additional fees and potential legal action.

7.Cancellation Policy

Cancellations must be made at least 7 days prior to scheduled delivery to avoid cancellation fees. Cancellations made less than 7 days before scheduled delivery may be subject to a cancellation fee of up to 50% of the rental cost. Special event rentals or large orders may have different cancellation terms, which will be specified at the time of booking.

8.Damage and Loss

Customer is responsible for any damage to rental units beyond normal wear and tear. This includes damage from vandalism, misuse, or acts of nature while units are in customer's possession. Lost or stolen units will be charged at full replacement cost.

9.Limitation of Liability

In no event shall Foothill Rentals or its partner companies be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use the Website or the Services. Our liability shall not exceed the amount paid for the specific rental giving rise to the claim.

10.Indemnification

You agree to indemnify and hold harmless Foothill Rentals, its partner companies, and their respective employees and agents from any claims, damages, or expenses arising from your use of the rental units or violation of these Terms.

11.Health and Safety

All portable restrooms are serviced according to health and safety standards. However, users should always practice proper hygiene and use units at their own risk. We are not responsible for injuries or illnesses that may occur from use of the rental units.

12.Changes to these Terms

We reserve the right to modify these Terms at any time. Your continued use of the Website and Services following any changes indicates your acceptance of the new Terms. We will make reasonable efforts to notify customers of significant changes.

13.Privacy

Your use of our Services is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

14.Governing Law

These Terms and your use of the Website and Services shall be governed by and construed in accordance with the laws of the State of Idaho, without giving effect to any principles of conflicts of law.
